  1. Im asking this on behalf of my husband. He wants to know when he will be able to file for bankruptcy again. He last filed on Dec2003 and was discharged on 2004.

  14. What if you have 2 homes and 1 is a rental and 1 is the one you live in and both are upside down. Can you continue to pay on these properties and still file banruptcy? And the secured debt amount is 1.7mil for the 2 properties.

  15. I have a few questions. 1) My husband lost his job about a year ago and still has not been able to obtain a job. Our credit card debit skyrocketed to $20,000.   17. Do 2nd & 3rd Mortgages count towards the unsecured debt limits? If they add up over the $336,000 in unsecured debt, does that mean you don't qualify for a chapter 13?

  22. I am overwhelmed with debt and would like to find out what my options are. I no longer know how much money I owe or where it is owed and my wages are now being garnished and I am about to have my driver's license suspended due to a debt that I am unable to pay in full. I would very much like a fresh start and to see where I stand. Will I be able to do a credit check/report and find out if I am eligible for bankruptcy even if I do not know the details of my debt?   23. Just curious. We own a house in Missourri that we have been unable to sell. The balance is 38,660.00. Our credit cards total8,00.00. We reside in Cali and our rent is 960.00 Our mortage is 358.00 monthly Seems like I cant get the cards down withe the mortage and credit cards.   28. I'm underwater on my mortgage. The home is worth below my first mortgage and on top of that I have a second mortgage as well. One of my vehicles was stolen and found a year later. The bank is coming after me for the whole debt even though they got the car. Insurance didn't cove me. I would be interested in a CH 13 but Right now I make a good income. I'm a commissioned employee and I'm having a good year, but that's not always the case. Please advise.

  29. I want to let the bank foreclose on my rental in Reno, NV. I need to know if they 1099 me, and if I go bankrupt, will I have to pay taxes on all of it or some of the approximate $150k. This house was purchased as primary residence--closed escrow May 2006--the absolute height. I've been losing money on it for 5 years. It's now worth 350% less than what I paid. Paid $268k. Now worth $75k, at best. Put 20% down & about $25k into it, and w/the 5 years’ loss, that’s around $85k. More than it is now worth. I just had a rental changeover. I had to rent it for substantially less. I cannot afford to keep it. I just got a new job that pays $48k/year. Was self-employed in real estate before and only made $33k this year, so got a job five weeks ago. After taxes with just rent, health insurance, and other true basics, I barely have enough to eat. Will, because I now have a job, have to do a Chapter 13 and pay back the taxes on the approx. $150k loss the bank will hit me with? Nevada is a recourse state and the loan is a recourse loan and unfortunately it is no longer a primary residence. I have an 800 credit score. I have no debt other than my car and a small low interest credit card loan. I can pay them both off now which would only leave me with around $3k. Should I pay them off now if I am thinking about bankruptcy? Also, I am a tiny partner in an LLC on an office bldg. in L.A. that hasn't made me any money for 3 years (too many vacancies), but thank goodness no capital calls. I go bankrupt, will my partners in the LLC be affected? The lender, ING Direct, is only willing to MAYBE lower the interest rate for 2 years. It was built in 1955. Over the next 25 years it will need a new roof, new plumbing, etc. I'm tired to throwing money into this albatross, that I am sure won’t sell for more than $50k, and am willing to let my great credit end. But will it really be wise? Will I actually owe more to the IRS even with a bankruptcy when ING Direct 1099s me? Now that I have a job, I'm sure that changes things.
